Area of application

The following General Terms and Conditions apply exclusively to all sales and other services between the VanMichenthal company and the consumer.

Other conditions of the consumer are not recognized unless they are expressly confirmed by the seller in writing. A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for a purpose that cannot be attributed primarily to their commercial or independent professional activity.

 

Offer

Our products are handmade and unique. Consequently, there may be small deviations from the product photos with regard to the illustration and representation of color and texture of the materials used as well as small deviations in the dimensions, which is not a reason for complaint. All errors excepted.

 

Contract conclusion

By concluding the contract, the consumer enters into a legally binding contract. Before the contract is concluded, the consumer has the opportunity to view and change the data entered at any time.

 

Price

All amounts stated are currently exempt from VAT due to the small business regulation.

Shipping

Free shipping within Austria. Free shipping to all EU countries from a purchase value of € 79.

 

Delivery and payment

The customer has the option of paying in advance (bank transfer), Paypal or credit card. If payment is made in advance, payment must be made immediately after completion of the order. If payment of the order is processed by third-party providers such as PayPal, their general terms and conditions also apply. The order will only be dispatched or processed after receipt of payment. If the goods are returned to the seller as undeliverable, the consumer shall bear the costs for the unsuccessful shipment if the fact of “undeliverable” is his fault.

 

Retention of title

The products remain the property of VanMichenthal until full payment has been received.

 

Warranty

The statutory warranty applies.

 

Recall

There is a withdrawal period of 14 days, but this does not apply if the product has been specially made to customer specifications (dimensions/choice of fabric etc.).

 

Data privacy

Customers' personal data is stored exclusively for internal purposes relating to the fulfillment of the contract and is not passed on to third parties (with the exception, of course, of the shipping service providers commissioned with the delivery). In accordance with the Regulation on Online Dispute Resolution in Consumer Matters (ODR Regulation), we would like to inform you about the Online Dispute Resolution Platform (ODR Platform), where consumers have the opportunity to submit complaints to the European Commission's Online Dispute Resolution Platform at https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=DE. However, we would like to point out that we are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
